State trial ct.
Opinion voiding vote
Case Information
A state challenge to the legality of considering constitutional changes to the congressional redistricting process in the legislature’s 2025 special session.
On Jan. 27, 2026, the trial court voided the legislature’s vote on the constitutional amendment, finding the Oct. 31, 2025, vote to be beyond the rules for the special session (and to be within, rather than before, the 2025 election, since early voting had already begun), and found that the vote did not amount to the second legislative vote necessary to submit the amendment to voters. The order has been appealed to the state supreme court; on Feb. 13, 2026, that court construed the trial court’s order to not enjoin the vote on the amendment itself while the appeal proceeds. As a result, the amendment will still be submitted to voters on Apr. 21, 2026.
