Case Information
A federal challenge to the state court decision in LWV of Utah v. Utah State Legislature, as allegedly violating the federal constitution under the “independent state legislature theory” largely rejected in Moore v. Harper.
On Feb. 23, 2026, the trial court denied the plaintiffs’ request for a preliminary injunction, finding both that the plaintiffs were unlikely to succeed and that the election was too close for the federal court to intervene for this cycle.
