Opinion rejecting challenge
Case Information
A state court challenge to the state’s description of a citizens’ ballot measure seeking to create an independent redistricting commission.
On Sept. 16, 2024, the state Supreme Court largely rejected the challenges to the ballot description, including a description that the measure would “repeal constitutional protections against gerrymandering” and would “require gerrymandering” based on the measure’s requirement of statewide partisan proportionality. The court required a slight adjustment to the ballot description of the measure’s judicial review and public input provisions.
