Case Information

State court challenge to state legislative districts. Plaintiff, a former state legislator petitioned the State Supreme Court alleging that the Idaho Commission for Reapportionment violated Art. III ยง 5 of the state constitution by splitting the state into too many counties.

On Nov. 23, 2021, the Court consolidated the case with Ada County v. Denney, and on Dec. 17, 2021, further consolidated the case with Stucki v. Denney, and Allan v. Denney.

Oral arguments occurred on Jan. 14, 2022. On Jan. 27, 2022, the Court upheld the maps in a unanimous decision, finding that the districts complied with the equal population requirement of the U.S. Constitution and complied with Idaho Code section 72-1506.
