A federal challenge to the reimposition of the 2022 congressional map pending a referendum on the 2025 re-draw, alleging that the referendum violates the federal constitution’s purported reservation of power to the state legislature, and alleging constitutional concerns with holding the general election under a different map than the primary.

On Sept. 8, 2026, the trial court granted a TRO, restoring the mid-decade map for the coming election.  The court rejected the “independent state legislature” argument but validated constitutional concerns with holding the general election under a different map than the primary.

On Sept. 10, 2026, the U.S. Supreme Court stayed the trial court’s TRO.  For practical purposes, that means the 2022 map will govern the 2026 elections.

(On Sept. 21, 2026, the Eighth Circuit ruled on the merits, purporting to direct the trial court to issue a permanent injunction restoring the mid-decade map; the trial court issued that injunction the same day.  On Sept. 25, 2026, the U.S. Supreme Court stayed the trial court’s injunction.)
