Case Information

A state challenge to the rejection of selected referendum petitions as premature, because a bill passed by the legislature had not yet been signed by the governor.

On Dec. 12, 2025, the trial court ordered the case in abeyance until the total submitted signatures were either certified or rejected as insufficient.

On August 17, 2026, after the Secretary of State finally announced his conclusion with respect to the signatures, the trial court rejected the challenge, and confirmed that would-be referendum petitions circulated before a bill has been signed by the governor are invalid.  The case has been appealed, and the Missouri Supreme Court has taken jurisdiction on an accellerated schedule.
