Case Information
A state court challenge against the congressional plan as an allegedly impermissible partisan gerrymander under the state constitution.
On Apr. 19, 2022, the court denied the plaintiffs’ motion for a preliminary injunction based on the proximity of the coming elections, but also denied a motion to dismiss.
On the state’s appeal, on July 5, 2023, the state Supreme Court held that partisan gerrymandering claims were justiciable under the state constitution (following the standard in Justice Kagan’s dissent in Common Cause v. Rucho), and remanded for further proceedings in the trial court.
On Oct. 6, 2023, the trial court found that the congressional map was not an egregious gerrymander in violation of the state constitution; on Nov. 27, 2023, the state Supreme Court affirmed.
