Case Information

A state challenge to Maryland’s new proposed constitutional amendment on congressional redistricting criteria, alleging that the language was passed in violation of state procedural requirements and that it violates the state’s single-subject rule.

On Aug. 28, 2026, the trial court granted summary judgment to the challengers, finding that the proposed amendment was untimely, inaccurately described, and contained multiple subjects.

On Sept. 3, 2026, the state supreme court reversed, reinstating the proposed amendment on the November ballot.  The court found that it met necessary procedural requirements, but found the summary misleading, and rewrote the summary for the ballot.
