Case Information
State court challenge of Newburgh’s at-large voting system under New York’s state voting rights act; the town defended the case by claiming that the state voting rights act violated the U.S. Constitution.
On Nov. 7, 2024, the trial court held that the state voting rights act was unconstitutional, because it required unequal treatment on the basis of race and did not satisfy strict scrutiny.
On Jan. 30, 2025, on appeal, the court reversed, holding that the town had not established that the state voting rights act would force it to violate the U.S. Constitution. The case is now being appealed to the state supreme court (called the N.Y. Court of Appeals).
