Case Information

Federal challenge to the 2023 congressional districts as demonstrating intentional racial discrimination and the unjustified predominant use of race, in violation of the constitution.

On Mar. 18, 2024, NC NAACP v. Berger II (which includes challenges to both the congressional and state legislative districts) was consolidated with this case.

On Apr. 8, 2025, the court granted partial summary judgment to the state, dismissing the NC NAACP plaintiffs’ malapportionment claims, and claims regarding several state legislative districts and one congressional district based on standing.  The decision preserved claims regarding most other challenged districts, however.  Trial began on June 16, 2025.
