Case Information

A federal challenge to the state House redistricting plan, as violating Section 2 of the Voting Rights Act.

On Feb. 17, 2022, the Court determined that Section 2 of the VRA does not afford a private right of action.  When the Department of Justice did not seek to intervene as a plaintiff, the court dismissed the case.

On Nov. 20, 2023, the 8th Circuit affirmed the district court’s dismissal of the case.  On Jan. 30, 2024, the circuit denied a request for rehearing en banc.

(Even without a private cause of action, plaintiffs in other cases may use another statute – 42 USC § 1983 – to assert a violation of section 2 of the Voting Rights Act.)
