Case Information

A federal challenge to the Arkansas House of Representatives redistricting plan. Plaintiffs allege the plan violates Section 2 of the Voting Rights Act and are asking the Court to enjoin the state from using the plans. Plaintiffs motioned for the judge to recuse himself for past financial support and personal ties to Defendant Governor Hutchinson and Defendant Attorney General Rutledge. The Court denied the motion on January 5th.

On Feb. 17, 2022, the Court held Section 2 of the VRA does not have a private right of action and that for the litigation to continue the United States Department of Justice must join the litigation. Plaintiffs appealed the decision to the Eight Circuit on February 23, 2022, and on January 11, 2023, the Eight Circuit heard oral arguments.
