Case Information

** This case was heard alongside, but not formally consolidated with, Contreras v. Ill. State Bd. of Elections, and later, E. St. Louis Branch NAACP v. Ill. State Bd. of Elections. **

A federal court challenge to state legislative redistricting plans based on census ACS estimates (used in order to meet the June 30 state constitutional deadline) rather than decennial census data, which were not available until mid-August.

On Oct. 19, 2021, the court granted summary judgment to the plaintiffs, finding that the state legislative plans using the ACS data were unconstitutionally malapportioned.

On Sept. 24, 2021, the legislature passed a new plan using decennial data, and plaintiffs amended their complaint to allege process violations, violations of the Voting Rights Act, and intentional racial discrimination.  On Dec. 30, 2021, the court rejected those challenges.
