Case Information

State court challenge to New York’s congressional and state Senate map, challenging the legislative process as unlawfully supplanting the state’s commission, and as a partisan gerrymander in violation of the state’s constitution.

On Mar. 31, 2022, the trial court struck both maps, holding that the state independent commission’s failure to submit a second proposal to the legislature deprived the legislature of the authority to redistrict on its own, leaving the process to the court to correct resulting malapportionment.  (The court also found the congressional map to be the impermissible product of partisan bias.)   On Apr. 21, 2022, the appellate court reversed the trial court’s findings on the legislative process, but affirmed the holding that the congressional map was an unconstitutional partisan gerrymander.

On Apr. 27, 2022, the state supreme court affirmed the trial court’s decision, finding both that the legislative process for the congressional and Senate map was flawed and that the congressional map was a partisan gerrymander invalid under the state constitution.

On remand, the trial court engaged a special master to receive proposals, and on May 21, 2022, approved new congressional and state Senate maps, moving the primary to August to accommodate the new plans.
