Case Information
A state court challenge to the congressional maps, alleging impermissible retrogression and vote dilution, intentional racial discrimination, unlawful partisan gerrymandering, and violations of protections for compactness and political boundaries, all under the state constitution.
On May 12, 2022, the trial court granted a temporary injunction on the grounds that the map dimished minorities’ opportunity to elect in violation of the state constitution, and ordered the implementation of the plaintiffs’ proposed map for the 2022 congressional elections. That decision was stayed on appeal on May 20, 2022, and then vacated on June 17, 2022.
On Oct. 27, 2022, plaintiffs voluntarily dismissed the claims around compactness and political boundaries. On Sept. 2, 2023, after a bench trial, the court struck the congressional map on grounds of impermissible retrogression under the state constitution, unlawfully diminishing the ability of Black voters to elect representatives of choice. On Dec. 1, 2023, that decision was reversed on appeal; the matter has been appealed to the state Supreme Court.
