Case Information
Federal court challenge to Alabama’s state legislative plan as an unjustified predominant use of race, in violation of the Fourteenth Amendment. On Dec. 6, 2023, plaintiffs filed an amended complaint instead alleging a violation of the Voting Rights Act with respect to the state Senate map alone.
On Sept. 24, 2024, the court denied summary judgment to the state. On Aug. 22, 2025, after a bench trial, the court struck the state Senate maps, finding that the plan diluted Black votes in the Montgomery area in violation of the VRA. The governor has refused to call the legislature into special session, so on Nov. 17, 2025, the court ordered the use of a remedial plan. The state has appealed both the liability finding and the remedial plan to the 11th Circuit; the plaintiffs have indicated that they may appeal the remedial order as well.
